1. About Ogrodut IT

Ogrodut IT provides web development and related website services, which may include website design and development, WordPress development, eCommerce development, website updates, troubleshooting, maintenance, performance improvements, and other agreed technical services.

The services available for a particular project will depend on the scope agreed with the client.

2. Enquiries, Quotations & Project Agreements

Submitting a contact form or contacting Ogrodut IT does not automatically create a service agreement.

After discussing your requirements, we may provide a quotation, estimate, proposal, or project scope.

Unless otherwise stated, quotations are based on the information and requirements available at the time they are prepared. Changes or additional requirements may affect the project cost, scope, or delivery time.

Before work begins, the project scope, price, payment arrangements, expected deliverables, and other relevant requirements may be agreed through email, proposal, quotation, invoice, freelance platform, or another written form of communication.

Any project-specific agreement takes priority over these general Terms where there is a conflict relating to that project.

Information on this website is for general guidance and may change without notice. It is not a binding project quotation or agreement unless specifically confirmed in writing.

3. Client Responsibilities

Clients are responsible for providing the information, content, files, access credentials, approvals, and other materials reasonably required to complete their project.

Clients are also responsible for ensuring they have the necessary rights or permission to use any text, images, logos, trademarks, software, or other materials they provide to Ogrodut IT.

Delays in providing required materials, access, feedback, or approvals may affect the project timeline.

4. Changes and Additional Work

Requests that fall outside the originally agreed project scope may be treated as additional work.

We will communicate any significant additional cost or timeline changes before proceeding with such work.

5. Payments & Project Delivery

Payment terms are agreed separately for each project and may vary depending on the type and scope of work.

Where a project is arranged through a third-party freelance platform or payment provider, payments may also be subject to that platform or provider's applicable terms.

Failure to make an agreed payment may result in work being paused or delivery being withheld where appropriate.

We aim to complete projects within agreed or estimated timelines. However, delivery dates may change due to changes in scope, delayed client feedback or materials, third-party services, technical issues, or other circumstances outside our reasonable control.

Any estimated completion date is an estimate unless a specific deadline has been expressly agreed in writing.

6. Intellectual Property

Unless otherwise agreed, clients retain ownership of content, branding, and materials they provide to us.

Upon completion of the project and receipt of all agreed payments, the client will receive the rights to the final website or project deliverables created specifically for them, except for third-party materials, software, licenses, reusable components, or tools that remain subject to their respective ownership and licensing terms.

Ogrodut IT retains ownership of its pre-existing tools, methods, reusable code, systems, and general development knowledge.

7. Third-Party Services & Compatibility

Websites may depend on third-party products or services such as hosting providers, domain registrars, WordPress themes, plugins, APIs, payment gateways, email services, analytics tools, or other software.

These third-party services are governed by their own terms and policies. Ogrodut IT is not responsible for outages, changes, discontinuation, security incidents, pricing changes, or other issues caused by third-party providers.

We aim to build and maintain websites using reasonable professional practices and support appropriate modern browsers and devices based on the agreed project requirements.

We cannot guarantee that a website will work indefinitely with every future browser, device, software version, plugin, theme, hosting environment, or third-party service without future updates or maintenance.

8. Backups and Website Maintenance

Unless backup, maintenance, monitoring, or ongoing support is specifically included in the agreed project scope, clients are responsible for maintaining appropriate backups and ongoing maintenance of their website after project completion.

Ogrodut IT's separate Website Care service is governed by its own service terms and is not automatically included with general web development projects.

9. Portfolio Use

Unless otherwise agreed with the client, Ogrodut IT may display completed public-facing work in our portfolio or use it as an example of our work.

We will not intentionally publish confidential client information or private access credentials.

Clients may contact us if they have specific confidentiality requirements regarding a project.

10. Service Limitations & Liability

We provide website development and related technical services, but we do not guarantee specific business results such as sales, revenue, search engine rankings, traffic, leads, conversions, or profitability unless expressly agreed otherwise in writing.

Ogrodut IT will use reasonable care and skill when providing agreed services.

To the extent permitted by applicable law, Ogrodut IT will not be responsible for indirect, incidental, or consequential losses arising from use of the website or our services, including loss of profits, revenue, data, or business opportunities.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

11. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our website, services, or business practices.

The latest version will be published on this page with the updated revision date.
